Yes, it is legal in the United States to meet, date, and marry someone from another country. But no one can legally buy a spouse. The phrase “mail order bride” is an old label for what is now usually international dating or matchmaking.
I have worked with couples for more than 30 years. When people ask me “are mail order brides legal”, I also want them to think beyond paperwork. A safe international marriage needs real consent, trust, fair choices, and respect.
Here is what U.S. law says and what I believe couples should discuss before marriage.
Are Mail Order Brides Legal in the United States?
The short answer is yes, but the wording can make the issue sound more confusing than it is.
There is no U.S. immigration category called a “mail order bride.” A U.S. citizen can legally meet a foreign partner online, through friends, while traveling, or through an international matchmaking service. The couple can then marry if they meet the normal marriage and immigration rules that apply to their case.
For example, an unmarried couple may use the K-1 fiancé visa route when the foreign partner plans to enter the United States for marriage. USCIS says the couple must intend to marry within 90 days of K-1 entry and generally must have met face to face during the two years before the petition.
A married couple may use a spouse-based immigration route instead. A legal marriage, however, does not mean every act around it is legal. Forced marriage, trafficking, abuse, and a sham marriage created only to obtain immigration status are very different matters.
The Department of Justice continues to prosecute alleged marriage-fraud schemes. In August 2026, for example, federal prosecutors announced charges in a case involving more than 1,000 alleged sham marriages.
What Does “Mail Order Bride” Mean Today?
The term comes from an older form of matchmaking in which men could view profiles or catalogs of women who wanted to meet foreign partners. Today, most cross-border couples meet through international dating sites, apps, social media, travel, or matchmaking agencies.
I do not like treating the term too literally.
A woman who moves to another country for marriage is not an item that was ordered. She is a person with her own family, history, fears, goals, money needs, and legal rights.
I have written before that international relationships can work very well when both partners treat cultural differences with respect instead of turning them into a contest.
For me, that is the better way to think about this topic. The important questions are not “Who ordered whom?” They are: How did you meet? Is the relationship real? Can both people make free choices? Is the immigration process lawful?
What Laws Apply to International Marriage Services?
International dating itself is legal. Certain companies that bring U.S. clients and foreign clients together may also fall under a federal law called the International Marriage Broker Regulation Act, or IMBRA.
How IMBRA Protects Foreign Clients
Under federal law, certain international marriage brokers must collect background information about a U.S. client before giving that person’s contact access to a foreign client.
The law can require information about matters such as prior marriages, certain protection orders, some arrests or convictions, and prior sponsorship history. Brokers also have duties related to checking the National Sex Offender Public Website.
The foreign client must receive required information before the broker releases personal contact details. The statute also calls for signed written consent from the foreign client for release of that information to a specific U.S. client.
I think this part matters far beyond paperwork. Informed consent means a person should have important information before making a serious choice.
K-1 and Marriage-Based Visa Rules
IMBRA is not a replacement for immigration law.
If a U.S. citizen wants a foreign fiancé to come to the United States for marriage, the couple may qualify for K-1 status. If they are already married, a spouse-based process may be the right route.
The K-1 path requires a real intent to marry. USCIS makes clear that the visa is not meant simply to give a couple 90 days in America to decide whether they might want marriage.
Legal International Marriage vs. Illegal Conduct
The easiest way to answer are mail order brides legal is to separate normal international dating from acts that break the law.

That sounds obvious, but I think it is worth saying clearly.
Why Consent Matters More Than the Label
A marriage certificate can show me that two people are legally married. It cannot tell me whether both people feel safe inside that marriage.
As a couples therapist, I care about whether both people can say yes and no.
If one person pays for flights, visa fees, a wedding, and most living costs, that does not mean the other person owes sex, obedience, housework, or silence in return.
I become concerned when I hear a message such as, “I paid for all of this, so you should do what I say.”
Generosity and control are not the same thing.
A healthy couple may have a large income gap. One person may even depend on the other for money for a period after an international move. That alone does not make the relationship unhealthy. What matters is whether money is used to support the couple or to take away one person’s choices.
My Relationship Safety Check Before an International Marriage
Before someone leaves a country, job, family, and support system for marriage, I would want the couple to have some very direct talks.
Ask yourselves:
- Can we both say no safely? A disagreement should not lead to threats about money, immigration, or abandonment.
- Have we talked openly about money? Discuss income, debt, bank access, work plans, bills, and personal spending.
- Do we both understand the immigration plan? One partner should not keep every form, deadline, and legal fact secret from the other.
- Can we stay close to family and friends? Marriage should not require cutting off your normal support network.
- Have we discussed daily married life? Talk about children, religion, sex, housework, careers, parents, and where you will live.
- Does either person feel they owe marriage in return for help? Immigration or financial support should never become a debt that removes free choice.

Moving Countries Can Change the Balance of Power
International marriage can create a temporary power gap even when both partners start with good intentions.
Money Can Become a Source of Control
The foreign partner may not have a job yet. They may have no U.S. credit history, no car, and limited access to their own money.
That can create normal stress. It can also create a serious problem if one partner uses financial dependence to control the other.
A healthy approach sounds like: “Here is our budget. Here is what you can access. Let’s make decisions together.”
An unhealthy approach sounds like: “This is my money, so I decide everything.”
Isolation Can Sound Romantic at First
Statements such as “I want you all to myself” can sound loving during courtship.
After a move, they can mean something very different if they turn into rules about who a partner can call, where they can go, or whether they can stay close to relatives.
The U.S. Department of State’s IMBRA rights guide states that domestic violence, sexual assault, and child abuse are illegal and that people in the United States can seek protection regardless of immigration status.
Cultural Difference or Relationship Red Flag?
Cross-cultural couples will disagree about some things. That is normal.
A cultural difference may sound like:
- “My parents are much more involved in marriage decisions.”
- “In my family, we send money to our parents.”
- “We have different ideas about privacy.”
- “Holiday traditions matter a lot to me.”
A control problem sounds different:
- “You are not allowed to disagree with me.”
- “You cannot call your family.”
- “I brought you here, so I make the rules.”
- “If you leave me, I will use your immigration status against you.”
I often tell international couples to ask what a habit means before they judge it. My work on intercultural marriage comes back to the same idea: different traditions can be understood and worked through.
But culture should never become an excuse for threats, fear, or loss of choice.
What Rights Does a Foreign Fiancé or Spouse Have?
A foreign partner does not lose basic legal protections because their relationship helped bring them to the United States.
The State Department states that victims of domestic violence can seek help regardless of immigration status. Its IMBRA materials cover legal rights related to domestic violence, sexual assault, child abuse, protection orders, and other resources.
K-1 and K-3 visa applicants may also receive available criminal background information about the U.S. petitioner that USCIS obtained from government sources. The consular process includes information about rights and protections.
That matters to me as a therapist.
A healthy relationship does not depend on one person believing, “I have no legal choices without my partner.”
Red Flags Before You Marry Someone From Another Country
International love does not require more suspicion than local love. It does require clear information because one person may soon make a very large life change.
I would slow down if:
- Important facts about past marriages keep changing.
- Money requests start very early.
- One person pushes for marriage before basic questions are answered.
- Only one partner controls immigration papers and passwords.
- Someone tells you to lie to immigration officials.
- Visa or deportation threats appear during arguments.
- Friends and relatives are pushed out of your life.
- One partner expects total financial control after the move.
- Anger appears whenever you set a reasonable boundary.
One odd moment is not always proof of a bad relationship. Repeated patterns matter more.
Are Mail Order Brides Legal if Money Is Involved?
Yes, normal expenses do not make an international relationship illegal.
People may pay dating-site subscriptions, matchmaking fees, airfare, visa costs, legal fees, wedding bills, or help with normal expenses. Couples also give each other gifts.
The problem starts when money is tied to fraud, force, exploitation, trafficking, or the belief that another person has been “purchased.”
Federal law also regulates how covered international marriage brokers handle information and consent. Violations can carry civil and criminal penalties.
So I would never ask only, “Was money involved?”
I would ask: What was the money for, and did both people still have a free choice?
What Is Changing for International Marriage Brokers in 2026?
There is one current legal update worth knowing.
On August 11, 2026, the Department of Justice published an interim final rule that sets procedures for handling alleged civil violations of IMBRA by international marriage brokers. It covers brokers accused of failures such as not providing required information or improperly sharing protected information.
The rule is scheduled to take effect on September 10, 2026. As of August 22, 2026, that effective date is still in the future.
The underlying federal statute provides civil penalties of $5,000 to $25,000 per violation, along with possible criminal penalties for certain conduct.
FAQ About Mail Order Bride Laws
Is It Legal to Marry Someone You Met on an International Dating Site?
Yes. Meeting online does not make a marriage illegal. You still need genuine consent and must follow the marriage and immigration laws that apply to your case.
Are International Marriage Brokers Legal?
Yes, but covered brokers doing business in the United States have duties under IMBRA. These can include background checks, disclosures, consent rules, and limits on sharing personal information.
Does a Foreign Spouse Have Protection From Abuse?
